SPORTIQ BASKETBALL MOBILE APPLICATION PRIVACY POLICY Your privacy is important to SportIQ. This Privacy Policy covers how we collect, use, disclose, transfer, and store your information. Please take a moment to familiarize yourself with our privacy practices and let us know if you have any questions. “SportIQ” as used throughout this Privacy Policy refers to SstazZ Oy, trading as SportIQ, and its affiliates and subsidiaries (also referred to as “we”, “us”, or “our”). “Application” as used throughout this Privacy Policy refers to the SportIQ Basketball Mobile Application. This Policy applies to data collected in connection with the Application, or from other interactions with us where a link or other reference of incorporation to this Policy is made. Collection and Use of Personal Information Personal information is data that can be used to uniquely identify or contact a single person. You may be asked to provide your personal information anytime you are in contact with SportIQ. SportIQ may use such personal information or share it with third parties as described in this Privacy Policy. Here are some examples of the types of personal information SportIQ may collect and how we may use it. What personal information we collect
  • When you create a SportIQaccount, register your SportIQ products, purchase a product, download a mobile application, download a software update or participate in an online survey, we may collect a variety of information, including your name, mailing address, phone number, email address, contact preferences, age, birth date, gender, height and credit card information.
  • When you share your SportIQ content with family and friends using SportIQ products, send gift certificates and products, or invite others to create a SportIQ account, SportIQ may collect the information you provide about those people such as name, mailing address, email address, and phone number.
  • When you use a SportIQconnected basketball, SportIQ will ask you to share certain information about yourself:
    • Account Information.To use connected functionality of a SportIQbasketball, you will need a free SportIQ account. In order to do this, you need to provide SportIQ with an email address and other applicable Personal Profile Information.
    • Personal Profile Information.In order to help you track your Game-play statistics and allow you to take advantage of all of SportIQ basketball functionality, SportIQ needs you to provide information about yourself which may include your email address, your SportIQ password, your SportIQ secret questions, your age, your gender, your height, your uniform number, your location, and your training goals.
    • Game-play Statistics.You can use the Application to record information generated during you or your guest’s games using a SportIQbasketball in order to keep track of you and your guest’s Game-play Statistics and other activities. This information may include, but is not limited to:
      • Your geographic location;
      • Your geographic location as it relates to other SportIQ basketball users;
      • The geographic locations of your past, current, and planned uses of a SportIQ basketball;
      • The date and time of your uses of a SportIQ basketball;
      • SportIQ basketball usage data, including, but not limited to:
        • Number of shots taken;
        • Number of made baskets;
        • Number of missed baskets;
        • Locations of shots taken;
        • Distance from the basket of shots taken;
        • Duration of use;
        • SportIQbasketball functionality used and duration of such use;
        • Number of games won;
        • Number of games lost; and,
        • Cumulative totals.
How we use your personal information
  • The personal information we collect allows us to keep you informed of product announcements, software updates, and upcoming events. It also helps us to improve our services, content, and advertising. If you don’t want to be on our mailing list, you can opt out anytime by updating your preferences. Personal information collected by the Application allows you to log in and create your user profile, track your games, identify Application users in your geographic location, receive and accept competition challenges from other Application users, and compare your Game-play Statistics to other Application users.
  • We may share your personal information with other Application users to allow such Application users to find Application users in their geographic location, solicit, accept and compete in SportIQ basketball challenges with other Application users, and compare their Game-play Statistics to other Application users.
  • From time to time, we may use your personal information to send important notices, such as communications about purchases and changes to our terms, conditions, and policies. Because this information is important to your interaction with SportIQ, you may not opt out of receiving these communications.
  • We may also use personal information for internal purposes such as auditing, data analysis, and research to improve SportIQ’s products, services, and customer communications.
  • If you enter into a SportIQ basketball sweepstakes, contest, or similar promotion we may use the personal information you provide to administer such programs, share your personal information with third parties that we engage to administer, develop, market or review such programs, or share your personal information with other SportIQusers who are participating in such programs.
  • We may provide to third parties non-personally identifiable information, including where such information is combined with similar information of other users of the Application. For example, we might inform third parties regarding the number of unique users who use the Application, the demographic breakdown of our users of the Application, or the products and/or services purchased using the Application and the vendors of such products and services. We may also provide to third parties personally identifiable information. For example, we might share our users' Personal Profile Information, Game-play Statistics and e-mail addresses with third parties in order for third parties to contact users about products and services that may be of interest. The third parties to which we may provide personally identifiable and non-personally identifiable information may be potential or actual advertisers, providers of advertising products or services (including vendors and website tracking services), merchants, affiliates and other actual or potential commercial partners, sponsors, licensees, researchers and other similar parties.
Collection and Use of Non-Personal Information We also collect non-personal information − data in a form that does not permit direct association with any specific individual. We may collect, use, transfer, and disclose non-personal information for any purpose. The following are some examples of non-personal information that we collect and how we may use it:
  • We may collect information such as zip code, area code, unique device identifier, location, and the time zone where the Application is used so that we can better understand customer behavior and improve our products, services, and advertising.
  • We also may collect information regarding customer activities on our other products and services. This information is aggregated and used to help us provide more useful information to our customers and to understand which parts of our website, products, and services are of most interest. Aggregated data is considered non-personal information for the purposes of this Privacy Policy.
If we do combine non-personal information with personal information the combined information will be treated as personal information for as long as it remains combined. Collection and Use of Location Information Some products or services offered within the Application require you to disclose certain location information. Location information includes, but is not limited to, any information we derive in order to identify your geographic position. This information may be collected from your wireless carrier, certain third party service providers, or directly from the SportIQ basketball or mobile device. The collection and tracking of your location information may occur even when the Application is not actively open and running. Your location information, however, is only displayed and shared in accordance with your established privacy settings. We may combine the personal information and/or the location information that you submit under your SportIQ account with information from other products or services or third parties in order to provide you with an enhanced experience and/or to improve the overall quality of the user experience. For certain services, we may give you an opportunity to opt out of the combination of such information. Our collection and processing of location information is subject to your consent, given by you in Application and device settings. In case you want to withdraw consent, you should just alter you device settings to not allow our Application to receive location data. Cookies and Other Technologies From time to time when you visit a SportIQ basketball website, information may be placed on your computer to allow us to recognize your computer in the form of a text file known as a “cookie”. Our use of cookies is intended to provide benefits to you, such as eliminating the need for you to enter your password frequently during a session or the need to re-enter items you place in a shopping cart if you do not finish a transaction in a single visit. Cookies are also used for website traffic analysis and anonymous demographic profiling so that we may improve our services. SportIQ may use so called web beacons (or “pixel tags”) in connection with some websites. However, we do not use them to identify individual users personally. Web beacons are typically graphic images that are placed on a website and they are used to count visitors to a website and/or to access certain cookies. This information is used to improve our services. Web beacons do not typically collect any other information than what your browser provides us with as a standard part of any internet communication. If you turn off cookies, the web beacon will no longer be able to track your specific activity. The web beacon may, however, continue to collect information of visits from your IP-address, but such information will no longer be unique. If you do not wish to receive cookies, or want to be notified before they are placed, you may set your web browser to do so, if your browser so permits. Please understand that if cookies are turned off, you may not be able to view certain parts of this site that may enhance your visit. Some of our business partners whose content is linked to or from this site may also use cookies or web beacons. However, we have no access to or control over these cookies. California Business & Professions Code Section 22575(b) (as amended effective January 1, 2014) provides that California residents are entitled to know how SportIQ responds to “Do Not Track” browser settings. SportIQ does not currently take actions to respond to Do Not Track signals because a uniform technological standard has not yet been developed. We continue to review new technologies and may adopt a standard once one is created. Disclosure to Third Parties SportIQ may make certain personal information available to strategic partners that work with SportIQ to provide products and services, or that help SportIQ market to customers. Generally, we do not sell, lease, rent or otherwise disclose your personal data to third parties unless otherwise stated below. Consent. We may share your personal data if we have your consent to do so. When you use some services, your personal data will be shared with the third parties you designate for access to such information including other web sites, your friends, relatives, or the SportIQ user community. You may change your settings at any time as to who has access to personal data by going to your account settings and then changing your publishing options. Authorized Third Parties. We may share your personal data with our affiliated group companies or authorized third parties who process personal data for SportIQ for the purposes described in this Privacy Policy. Such parties are not permitted to use your personal data for other purposes, and we require them to act consistently with this Privacy Policy and to use appropriate security measures to protect your personal data. International Transfers. Our products and services may be provided using resources and servers located in various countries around the world. Therefore your personal data may be transferred across international borders outside the country where you use our services, including to countries that do not have laws providing specific protection for personal data or that have different legal rules on data protection. In such cases we take steps to ensure that there is a legal basis for such a transfer and that adequate protection for your personal data is provided as required by applicable law, for example, by using standard agreements approved by relevant authorities (where necessary) and by requiring the use of other appropriate technical and organizational information security measures. If we decide to sell, buy, merge or otherwise reorganise our businesses in certain countries, this may involve us disclosing personal data to prospective or actual purchasers and their advisers, or receiving personal data from sellers and their advisers. Protection of Personal Information SportIQ takes precautions — including administrative, technical, and physical measures — to safeguard your personal information against loss, theft, and misuse, as well as against unauthorized access, disclosure, alteration, and destruction. SportIQ uses Secure Sockets Layer (SSL) encryption on all web pages where personal information is collected. To make purchases from these services, you must use an SSL-enabled browser such as Internet Explorer, Google Chrome, Firefox, or Safari. Doing so protects the confidentiality of your personal information while it’s transmitted over the Internet. When you use some SportIQ products, services, or applications or post on a SportIQ forum, chat room, or social networking service, the personal information you share is visible to other users and can be read, collected, or used by them. You are responsible for the personal information you choose to submit in these instances. For example, if you list your name and email address in a forum posting, that information is public. Please take care when using these features. Integrity and Retention of Personal Information SportIQ makes it easy for you to keep your personal information accurate, complete, and up to date. We keep your personal data only as long as we have a legitimate business need to retain it for the purposes described above, including for the purposes of satisfying any legal, accounting, or reporting requirements. To determine the appropriate retention period, we consider the scope, nature, and sensitivity of the personal data we process, the potential risk of harm from unauthorized use or disclosure, the purposes for which we process the data and the relevant legal requirements. We will also regularly assess the data we keep, and where we deem retention unnecessary, we will either erase or anonymize the data or, if this is not possible – for example, for information stored in backup archives – we will store the data securely and block any further processing until deletion is possible. We will usually retain personal data related to a customer relationship only for the duration of the relationship and for a reasonable period thereafter in order for us to be able to respond to inquiries or pending issues related to the relationship. However, some data may be retained for longer where we believe retention is necessary for compliance with laws or regulations (such as in the fields of accounting and taxation), or to exercise, establish or defend our legal rights or those of our customers, affiliates or partners. Access to Personal Information We make good faith efforts to provide you with access so you can request that we correct the data if it is inaccurate or delete the data if SportIQ is not required to retain it by law or for legitimate business purposes. We may decline to process requests that are unreasonably repetitive, require disproportionate technical effort, jeopardize the privacy of others, are extremely impractical, or for which access is not otherwise required by local law. Access, correction, or deletion requests can be made through the regional Privacy Contact Form. Children We do not knowingly collect personal information from children under 13. If we learn that we have collected the personal information of a child under 13 we will take steps to delete the information as soon as possible. California minors under 18 years old may request the removal of any information that they posted to SportIQ sites by contacting customerservice@sportiq.xyz. Upon such request, SportIQ will anonymize or remove from public view any content posted by a minor to one of its websites, unless required by law to retain such content or information. Third-Party Sites and Services The Application may contain links to third-party websites, products, and services. Our products and services may also use or offer products or services from third parties. Information collected by third parties, which may include such things as location data or contact details, is governed by their privacy practices. We encourage you to learn about the privacy practices of those third parties. Our Companywide Commitment to Your Privacy To make sure your personal information is secure, we communicate our privacy and security guidelines to SportIQ employees and strictly enforce privacy safeguards within the company. Legal Bases of Processing For the activities described in this notice, we rely on the following legal bases for processing personal data:
  • Performance of a contract between you and us;
  • Compliance with our legal obligations, such as data retention obligations related to accounting and taxation; and
  • Our legitimate interests to conduct and develop our business, where your interests and fundamental rights do not override those interests: This is the legal basis we mainly rely on for activities not covered by the above-mentioned legal bases, such as for managing our customer relationships as well as developing and marketing our products and services.
In individual cases, and where legally required for example in relation to location data, we may also rely on your separate consent.  You may later revoke your consent at any time. Automated Decisions In order to optimize the products and services we offer, we reserve the right to make automated decisions, including using machine learning algorithms, about our customers. Data Subject Rights You have the right to obtain from us confirmation as to whether or not personal data concerning you is being processed by us, and where that is the case, access to that personal data as well as to have any inaccurate or incomplete personal data rectified or completed. In certain circumstances, you may also have the right to request the erasure, or the restriction of processing, of your personal data or parts of it, to object to the processing and/or to receive the data in a structured, commonly used and machine-readable format.
